Right to Work checks for EU Nationals

Today is 30th June 2021 an important date for employers regarding their obligation surrounding Right to Work checks for EU Nationals.

As you will be aware, the UK officially left the European Union at 11:00 pm on 31 December 2020, as a result, all EU nationals that were living or working in the UK by that date had to update their right to work documentation to ensure they continued to be eligible to live and work in the UK. EU Nationals were given a grace period of 6 months until 30 June 2021 to ensure they applied for either EU Settled Status or EU Pre-Settled Status. 

Following  TODAY, 30 June 2021, and not before, as this was legally not allowed, you will need to: 

  • Ensure that all of your right to work checks are up to date, including checks for all nationals. If your EU National employee started work prior to 30 June and they already had leave to remain in the UK, you do not need to recheck their status.
  • Where you do not have a valid right to remain check for your EU National employees, you will need to contact them and ask them to provide evidence of their right to work in the UK.  This will be in the form of the EU Settled Status confirmation, EU Pre-settled confirmation, and in some cases visas.
  • Each individual must provide the evidence.
  • Failing to have the required evidence that you have completed the checks could result in a £20,000 fine for each individual that has not completed the checks.
